O foguista José Paulino da Silva foi acusado de furtar óleo da Estrada de Ferro São Paulo-Rio Grande e de tentar vender o óleo roubado depois. Um inquérito administrativo foi instaurado para investigar o roubo. O inquérito transcorreu sem que Silva apresentasse suas razões de defesa. Quando levado ao Conselho Nacional do Trabalho, este decidiu por sua procedência, entendendo que a intenção dolosa de Silva havia sido provada pelos testemunhos e que o inquérito havia seguido regularmente as leis estabelecidas.
